正義聯盟昨在旺角行人專用區設置街站,收集市民簽名。李偲嫣指警民關係現時達到嚴峻地步,不少市民經常以言語辱罵警員,警員承受巨大壓力,嚴重打擊警隊士氣,「警隊功能是除暴安良。我們支持警方執法,繼續維持治安。我們與律師正在研究辱警罪的細節。」李偲嫣指收集簽名期間,曾受到反對者言語辱罵及搶咪,在場有警員維持秩序,以防衝突場面。

旺角行人專用區昨亦有團體設置街站,為現場人士登記成為選民,並製作黃絲帶及派發印有雨傘圖案的衣服。義工張小姐指她們自發組織團隊,於星期六及日到旺角行人專用區設置街站,「前兩天我們已為30多名年輕人登記成為選民,我們會繼續派發黃絲帶,直到有真普選為止」。

我以前寫過4篇直接討論反對訂立辱警罪的文章(辱警,辱警二,辱警三————答民陣警權關注組召集人王浩賢問及辱警四),在這裏不再重複。簡單而言,反對的理由是平衡市民言論自由的權利,也不主張過份立法。如果訂立辱警罪,那麽官員被罵,公務人員被罵,老師被罵,私人機構所僱職員被罵,父親娘親被罵,該當何罪?老竇罵仔,你個死仔、X家摌(唔係畀晒啲家產佢喎)、生舊叉燒好過生你……之類,要立法規管嗎?可能有人會提出,既然有特别為保障警察的襲警罪,為何不能訂立辱警罪?兩者性質有別,警察執勤拘捕疑犯時,難免有肢體接觸,對他們身體安全保障需要較大,故此另訂一類罪行凸顯其嚴重性,在量刑方面也較嚴厲。
本篇想講的不是辱警罪本身,而是想講李思嫣,訂立辱警罪也不見得可以提升警察士氣,社會不和諧,警民關係差,辱罵風不改,訂定辱警法也枉然。李思嫣這號人,在正常的社會根本沒有出位的可能,就等如社會無病的話,14歲的孬女孩也不會被神化,道理是一樣的。可是,唱戲中的小丑跳樑,本應是比賽半埸出來表演跳草裙舞的啦啦隊,卻變了正印。當然,這正印只是提綫木偶,正如那14歲的小無知,也上了神檯一樣。這就是政治。我以前也講過,警察一定不要和李思嫣親近,本來對警察無惡感的市民,可能會被這人的醜行連累,對警察頓生反感,所以警察應該冷待她, 仿效孔夫子對待陽貨。修好警民關係也要有策略,不要像學民學聯那様無知地撐這孬女孩,將來的香港還有甚麽指望。政治當然充滿手段的,要利用社會事件來抽水聚資,也不要去淌渾水抽地溝油,笨得可悲!警察就真的要snub李思嫣之流,否則就中了背後那些'faceless men'的圈套了。

佔中有儍瓜,反佔中亦有笨蛋。追隨道理不要理虧。
回覆刪除要有辱警罪,那要不要有侮辱斯文罪?侮辱是甚麼罪?是不是就可以侮辱非警察?
Your Worship - amongst the rank and file and especially younger PCs, there is a lot of support for this law. However, I am in entire agreement with you, this is a horrible, horrible idea, and cannot possibly be enforced the way the boys want to. Arresting people for obstruction and breach of the public peace (or that old favourite loitering - not that you can do much of that these days) is already a political minefield when it comes to most public order events. What would happen if this were actually law, causing a backlash from the more radical activists? We didn't arrest everybody back in Admiralty or Mongkok and we still can't and won't, even if this were to become law (as I believe it actually is in Singapore), and the end result would simply be more confrontation, more backlash, and more frustration from both sides.
回覆刪除And this is just from a practicality point of view without at all looking at the issues with fumdamental freedoms.

P.S. Somebody is using my name but I think Your Worship has already noticed that. I may consider using an e-mail address to sign in in future, but I hope Your Worship will understand if I don't use my personal address. Too many colleagues have had had their online presence and that of their family turned against them in the past few months and it seems even Your Worship's blog is not entirely free from people who are perhaps not entirely rational when it comes to opposing points of view.
When a retired warship is no longer looming, it has become rusty and cannot be called a warship. Please use proper title. I am no more than an ordinary member of the society.
刪除It is the duty of the Commissioner to address the issue through proper course to soothe the nerves of the rank and file. I have done what I can and can do no more.
The best to safeguard your identity is to create a blogger or wordpress account and select that account to leave comment. I know somebody impersonated you in two comments in 女孩塗鴉之三. I remain vigilant against the impersonating aspect. I just deleted them. No need to use genuine information about yourself. It is understandable passion prevails over ration from time to time in the comments.
Having said that, I am afraid there is a lot of discontent amongst the rank and file. The likes of Mdm Lee are either incredibly cunning or being the proverbial stopped clock. They are driving a deeper wedge between the Force and the community, and picking the best way to do so being cheered (and jeered) from both sides.

刪除辱警是不對,但只是道德的範疇。可以譴責,難以能用法律規管。

個人認為要用法律條文把「辱警」定義和「愛國愛港」定義一樣困難。
品質兄,同意,不過最後那部份有異義,「辱」比「愛」在法律上容易介定。要立辱警法不難,只足不需要。

回覆刪除但降低"阻差辦工"的成罪要求卻很重要
例如嚴禁所有人進入警察臨時設置的封鎖區, 這樣就不會有港大學生被困後樓梯事件, 也不會有林老師事件 (因為一早被人拉了), 為什麼可以讓外人在警察工作範圍自出自入
又例如警察查身分證時, 故意將身分證掉落地下要警察執竟然不算是阻差 (training時阿SIR這樣教, 據說是有法官話警察自己執也只是用多幾秒, 一點也不阻)
再又例如, 拒絕保釋為什麼不是阻差. 我又不明白上大人為何不立即送他們上法庭等官大人判 (都夠證據拉, 我唔明點解唔夠過堂)
以上是小弟還在做警察時的怨氣
