廣東話是不是法定語文?

我湊熱鬧,但無意捲入政治論爭,不管教育局官方網頁撰文怎樣寫,之後的道歉,網民的批判,大公報加入戰團,我只講法定語文這一點。

甚麽叫法定語文?這問題可以從兩章法例去看,第一章要看的自然是香港法例第5章《法定語文條例》,該條例第3條這樣講:

(1) 現予宣布︰在政府或公職人員與公眾人士之間的事務往來上以及在法院程序上,中文和英文是香港的法定語文。 (1995年第51號第2條修訂)
(2) 各法定語文享有同等地位,除本條例另有規定外,在第(1)款所載用途上亦享有同等待遇。

這裏講中文是其中一種法定語文,並無申明甚麽方言。

另一章要看的是法例第一章《釋義及通則條例》第10B條:

(1) 條例的中文本和英文本同等真確,解釋條例須以此為依據。
(2) 條例的兩種真確本所載條文,均推定為具有同等意義。
(3) 凡條例的兩種真確本在比較之下,出現意義分歧,而引用通常適用的法例釋義規則亦不能解決,則須在考慮條例的目的和作用後,採用最能兼顧及協調兩文本的意義。

我引用這兩條法例來説明何謂法定語文。這兩條的標題涉及法定語文的地位與應用及釋疑,很明顯這法定語文所講的中文是書面語,故此中文法例都以書面語來訂立,而並非以港式廣東話(本地話)。用本地話來訂立法例可以嗎?我恐怕難度高,最主要的原因是我們一向以中文書面語為書寫的文字及學習對象,而書面語又以普通話的講法為藍本。

當然,有人會這樣爭拗:在法庭上的中文審訊,作供及陳辭,都可以用廣東話,那不就説明廣東話就是法定語言嗎?

先舉一例。如果與訟雙方,原告、被告、證人、律師及法官全部都講流利普通話,法庭程序以全普通話進行,在法庭的聆訊還需要傳譯成廣東話或英文嗎?當然沒有這必要。這樣做不妥當嗎?沒有不妥,因為普通話也是普及的方言,在香港的學校也有教授,公眾人士進入法庭也不會覺得訴訟用一種聽不明的語言在神秘地進行。到了頒佈判辭的時候,法官就會用中文書面語來撰寫,就算普通話的口語也不會在書面語的判辭中出現。我這樣講想表示法定語文在法律的層面是中文書面語,而並非口語。

一定有人爭拗法庭上用廣東話進行聆訊(除了終審法院),謄本紀錄也是廣東話,不是證明廣東話是法定語言嗎?這要看你怎樣去介定,我以法律條文的語言作介定。當然也有人以立法會的發言以廣東話進行作為論據,這様講也要從法律條文去看。文件A501《香港特別行政區立法會議事規則》有關發言的語文這樣講:

議員在立法會發言,可用普通話、粵語或英語。

如要做文章,為何沒有人為了普通話排在粵語之前而動肝火呢?講明是發言,強調的是口語,當然也可以用粵語讀出書面語的講稿。

這次本土語言爭拗十分無聊,講法定語文就應該以法律的角度去看。如果把「粵語」這詞輸入雙語法例資料系統(BLIS)去搜尋,只會出現上面A501這一例。如果用「廣東話」這詞去搜尋,就會出現兩例:

及法例123F章《建築物(規劃)規例》附表3第82條:

82. 暢通易達升降機廂內的顯示

(1) 升降機廂內須設有發光的視像位置顯示器,顯示—
      (a) 升降機廂的上下行方向;及
      (b) 升降機廂所在的位置。
(2) 發光的視象位置顯示器上的顯示數字或符號的高度,不得少於50毫米。
(3) 須有英語、廣東話及普通話的聲音報訊,顯示停留的層數。

在621章,廣東話被視為方言的一種(用 ejusdem generis rule來釋義),我希望有人找出法理依據來駁倒我這看法?

  1. Article 9 of the Basic Law provides "香港特別行政區的行政機關、立法機關和司法機關,除使用中文外,還可使用英文,英文也是正式語文。"

    Basic Law uses the term "正式語文", not the term "法定語文". However, the English translation for the term “正式語文” is “official language”.

    But what does the phrase “語文” stands for? The Constitution of the PRC may provide some hinds. Under Article 4, 121 and 134 of the Constitution, the term “語言文字” is used instead. The content of these 3 articles is about to the use of language in the autonomous areas.

    Based on reading of the above, my personal view is the confusion is caused by the “imprecise” use of the term “語文”. This term has composite meanings: “語言” and”文字”. The official English translation of the Constitution for the term “語言” and“文字” are “spoken language” and “written language” respectively. In this regard, I equate the term “語言” as“口語”, the term used by Bill.

    I would therefore argue, Chinese is the official “written” language and there is no official spoken language defined under the laws of Hong Kong. As such, any “Chinese” spoken language is a dialect. This includes both Cantonese and Putonghua.

    Also, maybe due to my overlook, I do not note Chinese is being defined as the official language in the Constitution of the PRC. Further, the status of Putonghua is ambiguous under the Constitution. Article 19 of the Constitution only provides “国家推广全国通用的普通话。”

    It should be noted that in the official English translation of the Constitution, Putonghua is defined as “common speech based on Beijing pronunciation”.

    As such, it seems crystal clear the Constitution of the PRC also recognizes Putonghua is a "dialect in origin".

    I wonder if the above does make any sense.

    1. I never doubt that Putonghua is only a dialect but it is very close to the written Chinese.

    2. Dialect is also a language in its own, and the reverse is also true. Putonghua merely means a common speech based on the Beijing dialect, nothing more. And the terms "language" loses its meaning when applying to Chinese, because Western languages do not distinguish themselves into speech and script as we do.

    5. 我不想涉入無謂論爭,你可以看到我基本上不在其他討論區或網誌留言,讀者在這裏留言,基於禮貌,我盡量答。我習慣在討論法例或判辭時引述原文,好讓讀者省卻搜尋的時間,也讓讀者看到原文自行理解。任何嘲諷批評,只要説出的道理有內函,何必計較。寧願見嘲諷的良言,好過讀溢美的廢話。我盡量減少論爭,實在花不起這種時間,況且無謂的論爭簡直是浪費生命。

  2. 標少, 我就不會說那麼多。憲法中的這一句也許已經很足夠: 「香港特別行政區的行政機關、立法機關和司法機關,除使用中文外,還可使用英文,英文也是正式語文。」 這裡所謂的「正式語文」, 當然用意是指法定語言文字。憲法這樣說, 有甚麼好爭議? 法定語言是甚麼, 不是看我們日常生活中主流常用的語言, 而是看有沒有法律依據。你可以挑戰憲法和法例, 但事實擺在你面前, 你卻扭曲他, 實在荒謬。

  3. 罵的人只有罵的情意結,有人提出「法定」,我自然要在法律裏面找依據。如果只講個人喜好,我就不能爭論,講法律釋義,就只好從法律裏發掘。有些看法一廂情願,憑空想當然,我只想具體一點從法律條文中找理據。

  4. Looking the matter from another perspective, as Cantonese, Putonghua or other dialects are part and partial of the Chinese language, one can argue they are all official language either.

    On the other hand, what happen if the Constitution of the PRC states “国家推广全国通用的上海话。”?
    Would Cantonese or Putonghua will become merely "dialect" in Hong Kong?

    I think the gist of the matter is what is the exact definition of the term "Chinese/ 中文“ under Hong Kong laws.

    1. All languages are "dialects", but that does not mean they are all "official" language/ speech as spoken and recognized by the government systems.

      "Official language" and related policy is a political issue, which take political capital to push. What result is a law called something alone the line of Official Language Act.

      As for Hong Kong, the colonial government did not want to push for an official Chinese speech or follow the official language policy of Mainland and Taiwan, but it had to deal with the fact that the vast majority of Hong Kong people speak some forms of Cantonese, so Cantonese became the de facto mainstream language and is recognized by governments systems, despite not being the official speech as defined by law. To argue whether it is "an official speech as defined by law" is entirely moot.

      Don't complicate matters unnecessarily.

  5. 純粹亂噏,可望 Siu 兄及網友指正。

    以「context」來分析,《法定語文條例》和《釋義及通則條例》中提及的「中文和英文」是指文字,而強加 spoken language/dialect 入內實屬庸人自擾。此看法似與《香港特別行政區立法會議事規則》、《一手住宅物業銷售條例》和《建築物(規劃)規例》相符,因以上各條例,分別明確指明有關情況是「發言」、「聲音廣播」和「聲音報訊」,故有需要列出相關的 spoken language/dialect。

    個人愚見是,如條例列明文字須為「中文和英文」,法官便須 as a matter of fact ,決定控辨雙方用的是否中文或英文。難道文字一定要百分百用「書面語」寫出,如文中夾雜「廣東字」、「福建俚語」、甚或古文,法庭就不能接受為中文?這便牽涉 fact and degree 的問題了。再說,「書面語」似乎也沒有一精確定義。

    1. 這又引領到另一課題:怎樣算是標凖中文?語文的運用不斷在改變,以前不能視為書面語的口語或潮語或英語結構的中文,漸漸認受性也多了,文言白話又是另一課題,我只能粗略講因為廣東話與中文書面語差距較大,比較難我手寫我口,處於比普通話較不利的地位。書面語也有地域性用法上的習性,香港中文書面語跟大陸台灣辭彙也有不同,再講下去就會是語文討論而不是法定語文的法律了。

    1. 他講程介南案,程介南要求由懂廣東話法官審,因為他會以廣東話作供,希望講法可以「原汁原味」聽他的證供,講法不會lost in translation, 因為聼審的法官只懂英文。夏正文法官在該案判定廣東話是官方語文嗎?一開始,他作了前提假設,原判辭第三段貼在下面,這判辭真的在講中文是甚麽嗎?

    所以,教育局道歉没問題!因為跟本没有法定語言這回事!

    1. 你「因為根本没有法定語言這回事」這一句我卻不能同意,因為法律上確有法定語文,其一是中文,只不過法例沒有介定中文是指口語或書面語,而口語是指那種方言。

    3. 教育局的文章是指廣東話是"一種不是法定語言的中國方言". 否定廣東話作為法定語言之一.

      而《法定語文條例》"在政府或公職人員與公眾人士之間的事務往來上以及在法院程序上".

      若果兩者皆正確的話, 在政府或公職人員與公眾人士之間的事務往來上用"不是法定語言的中國方言"(即廣東話), 是不是違法, 或者沒法律效力?

    4. 其實我篇文把法定語文解釋為中文的書面語,至於口語溝通則主要是廣東話,或者其他方言,只要溝通得到或經傳譯來溝通。再遠一點的殖民地時代如果要寫信給政府或呈遞表格,如果中文不是法定語文,你就一定要用英文寫。到了現在可以中文寫,在書寫的層面,用的也會是書面語,而不是把廣東口語寫成文字,如果寫了書面語,用廣東話讀出來,那文字本身當然是中文,用甚麽方言讀出不同的音也不會改變它的文字功能及意思。中文的法例用那種方言讀出來,都沒有改變其文字,所以我強調法定語文是書面中文。在法庭上,如果把控罪讀給被告聽,都會看著書面語而口語化讀出來,作為官方紀錄,用的也是書面語,所以無論是判辭、契約、控罪都會是書面語的中文。但把這些文件內容講出來的時候,很多時會口語化。故此用方言不會違法,但依靠的會是文字,法律効力主要是文字方面。一個講廣東話的人跟講上海話的人訂立合約會用書寫的中文而不會用各自的方言。

      兩個貌似中國人的人在悉尼街頭相遇,先講英文,然後知道對方識講中文,都會先搞清楚講甚麽方言What dialect do you speak?如果對方識寫中文,你就不會問What Chinese do you write?

      我理解 語言 = 口語 = 方言, 既然你講法定語文是指法定中文的書面語, 即係法律跟本無没有法定語言/口語 / 方言這回事, 那教育局所說的 "廣東話不是法定語言"是錯的了!

    6. 也許我混淆了,語文及語言真的可以這樣分嗎?語文也可以是語言文字,相反語言這詞又可包括口語和書面語。書面語只有一種,口語卻有多種不同方言而發出不同聲音。本文一開始已説明不評論教局的撰文。

    7. 語文及語言真的可以這樣分嗎?真的需要這樣分,書面語是一種語文格式,讀出來的才是語言,而同時廣東話可以完整的表達出書面語。

      普通話 = 書面語?不完全是,最少語彙應用上中港台也稍有差別,其中「素質」「質素」是一個例子,另外普遍話亦有非傳統書面語的詞彙及發音出現,例如普通話「很牛」在內地廣泛認知為「很厲害」的意思,但傳統書面語或中文字典上不存在這種解釋,更證明了普通話 = 書面語是一種錯誤的理解。

      作為我們母語的廣東話(香港政府指的母語教學,是廣東話吧),在香港的普及性亦相信遠遠大於普通話,很明顯能操流利普通的人只為少數。

      法律上單單以中文、英文來傳釋法定語言,亦以文字作為重點的時間,那麼廣東話作為香港地區的母語,亦能有效表達出書面語,廣東話自然是法定語言。

      一國兩制下,當然以香港本地需要作為法律根本吧?不是嗎?別被政治影響了理性判斷。

    8. 如果説我看法徧頗,那是觀點不同的結果。如果説我被政治影響了理性判斷,恐怕不太公道。我寫這一篇只看法律,完全apolitical。我完全不爭論以廣東話教學及廣東話在香港的普及性,我沒有任何打倒它的意圖。但我不贊成理所當然的講法,因為那不闡釋法律的態度。

      要舉地域詞彙不同的例子,可謂多不勝數。那只説明那是大陸的講法、台灣的講法或香港的講法。英文也同樣有英式、美式或澳式的詞彙。譬如香港叫青椒、紅椒或燈籠椒,美國叫green pepper, red pepper or bell pepper, 而澳紐叫capsicum。這種例子已偏離了我們討論的課題。

  8. 應用普通法「如無定義,以字面意思解釋」的原則,相關的法律問題是「廣東話是否中文」、「普通話是否中文」、「上海話是否中文」等,而全部問題都答「是」,應該是沒有抵觸的。

    用 Siu 兄的例子 -「先舉一例。如果與訟雙方,原告、被告、證人、律師及法官全部都講流利〈普通話〉,法庭程序以全〈普通話〉進行,在法庭的聆訊還需要傳譯成廣東話或英文嗎?當然沒有這必要。」假如以「上海話」代替「普通話」,我想答案還是一樣的。

    說回文字,一篇用「三及第」文字〈即白話文、文言文和廣東話字句〉寫成的陳詞,我想法官也不會以陳詞不是中文斷然拒收。

    1. 法官可能要求講或寫得莊重,上訢判辭也可看到高院法官批評裁判官遣辭用字不夠莊重。

  9. 英文也有很多方言, 美式英語, 澳洲英語, 英格蘭內都有不同方言. 香港的法定英文是什麼? 美式英語, 澳洲英語是否香港的法定英文的一部份? 香港政府用的英語跟英格蘭內的不同方言也有不同, 香港政府用的英語是否也只是一種方言?

    1. 如果講法律上的英語,我只覺是英國那一套。美國及澳洲式,大多數是俚語,而不是方言。香港英語當然也有些港式的辭彙,但不致於稱上方言。我只能講這些印象話,深層次的我不懂。但不要把串法、發音及口音當作方言,愛爾蘭的可能算得上。

    3. 我不清楚你想指出甚麽,英、美、澳、加的英文絕大部份發音、詞彙、串法都相同,分别在於口音,總不能叫方言嗎?新加坡的口音就比較奇特。我英文不好,發音不凖,你不能把我講的英文變成方言,那只能説英文水皮。

For linguistics purposes, they are, in fact, considered "dialects" (the North American English dialect consists of Southern dialect, New England dialect, Canadian dialect, etc.), and a dialect can consist of many dialects. In essence, they are no so different, and substantively they are just the same thing. We make distinction out of convention, because we need to recognise the practical differences.   10. 語文包括了口語和文字. 有人認為香港人的書面語較接近普通話, 所以普通話應該是香港的法定語文. 但香港人的口語較接近粵語, 粵語是否也應該是香港的法定語文?

    既然法律, 法院, 立法機關都沒有定義方言與非方言的法律地位, 誰有法律地位去判定普通話或粵語是否香港的法定語文?

  11. 如果要講語言學的問題,當然由語言學家去講,也有典籍作參考,譬如研究現代漢語的書及辭典。如果講語文的法律地位,可以由法庭去裁決。提出看法的大眾可以各自表述,標少是大眾的一份子,從法例方面去發掘,提出粗淺看法,有沒有説服力就要讀者從文章內容及留言討論,自己去判斷。但我可以肯定講,我有看法但並非權威,也無賣假藥。

  12. 你錯誤地使用ejusdem generis rule,因為621條文中包含了'普通話'這一項,咁即係普通話都係方言的一種嗎? ejusdem generis rule不是這意思,是other items is of the same kind of the previous item(or items), 你不能因為後面other items係寫住方言所以就用這一點來justify 之前的previous items都全部係方言,如果係咁樣解讀的話,即係話second item(普通話)都係方言?如果不是的話,咁other items並不一定局限於方言,ejusdem generis rule係用來解讀甚麼可以列入other items之中,但並不能用來define and limit前面的items

    1. 我真的錯?首先,普通話本質上是方言,跟廣東話一樣,其次Cap621,S72(3)(b) 如純粹或主要採用廣東話、普通話或其他中國方言,這裏的字眼「或其他中國方言」are to be construed ejusdem generis with those which precede them.普通話是甚麽?原本是北京周圍的一種方言。

      This is what I get from The Free Dictionary:

      ejusdem generis (eh-youse-dem generous) adj. Latin for "of the same kind," used to interpret loosely written statutes. Where a law lists specific classes of persons or things and then refers to them in general, the general statements only apply to the same kind of persons or things specifically listed. Example: if a law refers to automobiles, trucks, tractors, motorcycles and other motor-powered vehicles, "vehicles" would not include airplanes, since the list was of land-based transportation.

  13. I am very grateful to Montwithin for pointing out that the “Law of the People's Republic of China on the Standard Spoken and Written Chinese Language” which I do not come across before. Article 9 does spells out there is a difference between written Chinese language and spoken Chinese language. However, as this Law is not under Annex III: National Laws to be applied in the Hong Kong Special Administrative Region and therefore not part of the Hong Kong laws, one cannot assume Putonghua is the official spoken language in Hong Kong per se.

    The present discussion starts with an article on the Education Bureau's website claiming “Although the Basic Law stipulates that Chinese and English are the two official languages in Hong Kong, nearly 97 per cent of the local population learn Cantonese (a Chinese dialect that is not an official language) as their commonly used daily language."

    Given the way it is being written, the writer of this article must, in mind, an official spoken language and I wonder what is it?

    In any event, I do try to search the HKLII for a definition of the term “Chinese language/ 中文” but to no avail.

    If I did not make any mistake in my research, given the absence of statutory definition of the term “Chinese language/ 中文” in the laws of Hong Kong but the fact that the Hong Kong statutes do provide a distinction between spoken language and written language (based on the examples as cited by Bill), I would argue, taking local Chinese custom as a source of law, Cantonese (or Punti?) is the official spoken language.
