125刀的誤殺

子斬父百刀 母延報警脫誤殺

向陪審團拱手鞠躬

【明報專訊】61歲老人院清潔女工，下班返家後赫然發現其患精神病兒子狂斬76歲老父，丈夫身中125刀受傷倒地，為保兒子不被檢控，及恐怕房署發現其寓所是堆滿垃圾的「垃圾屋」，她涉延兩周後始報警，其間只以跌打酒替丈夫治療。清潔工被控嚴重疏忽致誤殺，但經審訊後陪審團昨一致裁定她罪名不成立。

斬傷父親的獨子鄺遠迢（24歲）早前已承認誤殺罪，法官將於下周二判刑，他被捕後一直被還押小欖病院。沒有兒子在身旁且喪夫的被告黎瑞賢，連日審訊也是獨來獨往，昨天她得知獲判無罪後連連拱手向陪審團道謝，更在陪審團離庭時邊向他們拱手鞠躬，邊大聲道︰「多謝晒，你用公平公正審我件案……貴人唔該晒！」

陪審團一致裁無罪

案情透露在2009年10月11日，兒子涉為阻止父親鄺景南外出賭馬，在坪石寓所用菜刀狂斬父親，被告返家後發現丈夫受傷，在往後兩周只替丈夫施以跌打酒、活絡油，以及給他服用「通脈丹」及鹿茸等。直至同月25日凌晨，她與兒子以摺作擔架，將丈夫綁在摺上，然後將他抬到彩虹附近，再致電召喚救護車，惟救護員到達時發現鄺景南已死。(16/2/2012明報節錄)

這件案的結果是意料中事，並非標少懂得有關法律，而是看了司法機構星期一上載了本案法律上的裁決，而推斷審訊結果。死者的妻子被控誤殺基於3個元素

(i) having a duty of care towards KWONG King-nam both by virtue of her relationship with him and/or by accepting such a duty;
 (ii) breached that duty of care by failing to obtain proper and adequate medical care for the said KWONG King-nam; and
(iii) that breach of duty caused the death of KWONG King-nam and was in all the circumstances grossly negligent  (HKSAR and Lai Shui Yin(黎瑞賢) HCCC29/2011)

這是從控罪抄出來的。控方的論據是被告身為死者的妻子，在法律上屬嚴重疏忽的誤殺，考慮的標準是客觀合理的標準(the test is an objective one)；辯方的爭論是測試的標準應該是主觀的標準，極其量也是兩層次-----客觀然後主觀的標準(should either be a subjective one or a two-tiered objective-subjective test )。

聽審此案的張慧玲法官的裁決是

The elements/ingredients of the offence of gross negligence manslaughter set out in Adomako are applicable, that is to say, the jury has to decide (1) whether the defendant has been in breach of a duty of care towards the deceased; (2) if such a breach of duty is established, whether that breach of duty caused the death of the deceased; and (3) if so, the jury must go on to consider whether that breach of duty should be characterized as gross negligence and therefore a crime. However, the test as to what would amount to gross negligence is not just an objective reasonable man test, but the prosecution must prove that the defendant’s subjective state of mind was culpable before she can be found guilty of this offence. 簡單講一般人對被告延誤召援救護車，導致死者失救，會覺得是嚴重的疏忽。法官在法律上裁定，如果陪審團覺得被告主觀認為，用跌打酒、活絡油、通脈丹及鹿茸來療傷，可以救治這125刀的刀傷，就不能把她定罪。

也許挨了125刀，撿回的命也會是破破爛爛的一條爛命，生不如死。
