雪山MGN

前兩篇我評論了嚴重疏忽導致誤殺罪 (manslaughter by gross negligence), 近日各大國際媒體都報導了一宗登奧地利Grossglockner雪山衍生出來的嚴重疏忽導致誤殺案, 我採用英國獨立報(Independent)的報導:


簡而言之, 一對情侶一起攀爬奧地利的雪山, 男的攀山經驗豐富, 女伴是新手。攀爬到差不多登峯的時候 (Grossglockner 高3798米), 女生感到不適, 男的沒有即時求救, 把女的丟下, 自行落山求救, 6個半小時後折返, 女伴已凍死了。控方指被告在爬山前籌備不足, 把女伴丟下的地方位置不適合, 也沒留下禦寒裝備給她, 又沒有聯絡救援隊及警察。這種誤殺都算罕見。控方的講法符合控罪四大元素: duty of care, the breach of it, lead to the death of the victim and this death is foreseeable。被告爭論控方的案情, 其中一理據是把女伴丟下是雙方協議的。本案的發展, 拭目以待。

我搞的羽手球會, 實際上是興趣小組而並非會社, 但也清楚寫出免責條款, 訂明搞手對球友無需負任何謹慎責任的(owe no duty of care), 報名參加者要同意這條款, 另外, 我還不時提醒行為危險的人注意自身及球友的安全, 除了免責聲明, 還有恪盡職守(due diligence), 才致無懈可擊, 確保一點contributory negligence也沒有。最近有位老人家因年紀大, 反應遲緩了, 連續跌倒, 勸他不要再打羽毛球, 他總是不聽, 我只好強硬對付禁止他來。因此, 我背負了惡名。把以上爬山搞出誤殺案作比較, 可預見老人家打羽毛球致命的風險, 還心存姑息僥倖讓他打下去, 到意外奪命時很多人會推卸責任, 我為何不用霸氣把他攆走? 做事有擔當, 不怕肩負惡名, 才能解決問題, 到了今時今日, 我做得罪人的事還怕甚麼?

宏福苑大火, 政府脫不了contributory negligence的責任。先前網上傳聞委任獨立委員會主席可能是兩位剛退休的上訴庭法官Anthea Pang及Maggie Poon其中一位。Anthea Pang是火箭人, Maggie中規中矩由裁判官做到上訴庭, 兩位都並非獨立委員會主席的適合人選, 我寫到這裏就發覺剛委任了David Lok。兩位剛退休的女官為甚麼不合適? 皆因她們一直都在辦刑事案, 沒有做民事或司法覆核案的。彭官沒有私人執業過, 入DoJ的刑事檢控科後, 轉職區域法院至上訴庭, 都是處理刑事的, 她是近年升職最快的法官。而在我的記憶中, Maggie私人執業時主打刑事, 入職裁判官至上訴庭, 都主審刑事案。她們都是釘官, 另一共通點我不宜在此透露, 退休後都不想執獨立委員會主席這豬頭骨喇, 要再接受任命都只會是高院暫委法官, 但這也可能性不大。真的要做不如申請延任上訴庭法官。我在大內已沒有線眼, 所講的全是揣測。David Lok是選管會主席, 在法官階梯中並非升職位, 委任他也不影響日常其他工作。他的能力是否獨立委員會主席的適合人選, 我太生疏了, 所以不評論。從李家超發佈的獨立委員會職權訊息, 回應了坊間對不設立獨立調查委員會的批評, 算是他近年做得比較出色的一次, 我有點意外, 可能是背後高人的功勞吧, 我不在此詳述他的公佈, 網上都可找到的。

    俾他來打都得, 但要满兄一些條件, 例如:
    •他有家人在場陪同和監察他在打球前是好好的沒有異樣和不適才可落場, 和在打球時的身體狀況變化, 一變差便要立即制止;
    •有體能訓練員在場指導, 他落場前要有足夠熱身, 打一段時間便要休息, 之後再打, 適可而止, 不可過量;
    •只准他打單打, 以免和隊友碰撞;
    •有熟識急救的人駐場;
    •球場有急救箱等等

  2. 覺得打羽毛球那急速轉腰的動作,對腰椎是蠻大的負擔。

    1. 急速來回跑動接球, 跳躍扣殺等動作對膝蓋和關節的負荷/勞損也很大, 老人家如熱身不夠或狀態不佳, 很易受傷.

    1. There were options open to the accused. He could stay with the girl and use his mobile to seek help. The news I read said he connected with the helicopter once and then turned his mobile to silent mode. The helicopter tried to call him many times, but he did not pick up the calls.

    1. Nothing in common. The American is a gun country. Shooting is a norm. Bondi beach is a terrorist attack, a retribution to the atrocity of the Israeli massacre in Palestine. Sad but foreseeable. Terrorists and murderers should both be condemned.
